Article 1 (Purpose)
These terms and conditions are intended to regulate the rights, obligations, and responsibilities of the Cyber Mall ("Mall") operated by Aperos Company (e-commerce business) and the users in using the internet-related services ("Services") provided by Aperos Cyber Mall.
※ "These terms and conditions also apply to electronic commerce utilizing PC communication, wireless communication, and other similar methods, unless they contradict their nature."

Article 2 (Definitions)
① "Mall" refers to a virtual business place established by Aperos Company, using computer or other information communication facilities, to provide goods or services (hereinafter referred to as "Goods, etc.") to users through transactions. It also refers to the operator who operates the cyber mall.
② "User" refers to a member or non-member who accesses the "Mall" and receives services provided by the "Mall" according to these terms and conditions.
③ "Member" refers to a person who has registered as a member of the "Mall" and can continuously use the services provided by the "Mall".
④ "Non-member" refers to a person who uses the services provided by the "Mall" without registering as a member.

Article 3 (Publication, Explanation, and Amendment of the Terms and Conditions)
① The "Mall" shall display the contents of these terms and conditions, as well as the name, representative's name, business address (including the address for handling consumer complaints), telephone number, facsimile number, email address, business registration number, online sales registration number, and personal information protection manager's contact information of the "Mall" on the initial service screen (front) of the Aperos Cyber Mall, in a manner easily accessible to users. However, the contents of the terms and conditions may be provided through a connected screen for users to view.
② Before users agree to the terms and conditions, the "Mall" must provide a separate connected screen or pop-up screen to ensure that users can understand important contents such as withdrawal of subscription, delivery responsibility, refund conditions, etc. stated in the terms and conditions, and obtain users' confirmation.
③ Within the scope not violating the laws and regulations related to the Consumer Protection in Electronic Commerce Act, Act on Regulation of Terms and Conditions, Electronic Documents and Transactions Act, Electronic Financial Transactions Act, Electronic Signatures Act, Act on Promotion of Information and Communications Network Utilization and Information Protection, Door-to-Door Sales Act, Consumer Basic Act, etc., the "Mall" may amend these terms and conditions.
④ When the "Mall" amends the terms and conditions, it shall provide a notice on the initial screen of the Mall, along with the current terms and conditions, stating the effective date and the reasons for the amendment, from 7 days prior to the effective date of the amendment until the day before the effective date. However, in case of changing the terms and conditions to the disadvantage of users, the "Mall" shall give a notice with a minimum of 30 days prior notice. In this case, the "Mall" clearly indicates the amended contents and compares them with the previous contents to make it easy for users to understand.
⑤ The amended terms and conditions shall only apply to contracts concluded after the effective date of the amendment, and the previous terms and conditions shall apply to contracts already concluded. However, if a user who has already entered into a contract wishes to be subject to the amended terms and conditions, they may send their intention to the "Mall" within the notice period of the amendment as specified in paragraph 3 and obtain the consent of the "Mall." In this case, the amended terms and conditions shall apply.
⑥ Matters not specified in these terms and conditions and the interpretation of these terms and conditions shall be governed by the laws and regulations related to the Consumer Protection in Electronic Commerce Act, Act on Regulation of Terms and Conditions, guidelines for consumer protection in electronic commerce established by the Fair Trade Commission, and relevant laws or commercial practices.

Article 4 (Provision and Modification of Services)
① The "Mall" performs the following tasks:
    1. Providing information on goods or services and concluding purchase contracts
    2. Delivery of goods or services for which purchase contracts have been concluded
    3. Other tasks determined by the "Mall"
② In the event of the goods or services being sold out or changes in technical specifications, the "Mall" may change the contents of the goods or services to be provided under future contracts. In such cases, the "Mall" immediately notifies the changed contents of the goods or services and the date of provision on the place where the current contents of the goods or services are posted.
③ If the "Mall" intends to change the contents of the services contracted with users, such as the sale of goods being discontinued or changes in technical specifications, the "Mall" promptly notifies the users to the address where the notification can be delivered.
④ In the event of the preceding paragraph, the "Mall" compensates for any damages suffered by users. However, this shall not apply if the "Mall" proves that there was no intention or negligence on their part.

Article 5 (Suspension of Services)
① The "Mall" may temporarily suspend the provision of services in the event of maintenance, replacement, breakdown of computer or information communication facilities, or interruption of communication.
② In the event that the provision of services is temporarily suspended due to the reasons stated in paragraph 1, the "Mall" compensates for any damages suffered by users or third parties. However, this shall not apply if the "Mall" proves that there was no intention or negligence on their part.
③ In the event that the "Mall" becomes unable to provide services due to reasons such as a change in business type, abandonment of business, or integration between companies, the "Mall" notifies users in accordance with Article 8 and compensates consumers in accordance with the conditions initially presented by the "Mall". However, if the "Mall" fails to notify the compensation criteria, the "Mall" shall provide users with goods or cash equivalent to the mileage or points accumulated by users at the prevailing currency value used by the "Mall".

Article 6 (Membership Registration)
① Users may apply for membership by completing the registration form provided by the "Mall" and expressing their consent to this agreement.
② The "Mall" registers users as members unless they fall under any of the following items:
    1. If the applicant has previously lost membership status under Article 7, paragraph 3 of this agreement, except in cases where three years have elapsed since the loss of membership and the applicant has obtained approval from the "Mall" for re-registration.
    2. If there is false, incomplete, or incorrect information in the registration details.
    3. If it is determined that registering the user as a member would significantly hinder the technical aspects of the "Mall."
③ The time of establishment of the membership registration agreement shall be the moment when the "Mall's" acceptance reaches the member.
④ If there are any changes to the registered information provided during membership registration, the member must promptly notify the "Mall" of such changes through the method of modifying member information or other appropriate means.

Article7 (Membership Withdrawal and Loss of Qualification)
① A member may request to withdraw from the "Mall" at any time, and the "Mall" will promptly process the membership withdrawal.
② If a member falls under any of the following items, the "Mall" may restrict or suspend their membership:
    1. If false information was provided during the registration process.
    2. If the member fails to make payment for the price of goods or other obligations related to the use of the "Mall" by the specified due date.
    3. If the member hinders the use of the "Mall" by others or engages in the theft of their information, thereby threatening the order of electronic commerce.
    4. If the member engages in acts prohibited by law or this agreement, or acts that are against public morals and customs, through the use of the "Mall."
③ After restricting or suspending a member's qualification, if the same act is repeated twice or the reason is not corrected within 30 days, the "Mall" may cancel the member's qualification.
④ When the "Mall" cancels a member's qualification, their membership registration will be invalidated. In this case, the "Mall" shall notify the member of the cancellation and provide an opportunity to present their case for at least 30 days before the cancellation of the membership registration.

Article 8 (Notification to Members)
① When the "Mall" gives notice to a member, it may be sent to the email address agreed upon between the member and the "Mall."
② In the case of notifying an unspecified number of members, the "Mall" may post the notice on the "Mall" bulletin board for at least one week instead of individual notifications. However, individual notifications shall be made for matters that have a significant impact on the member's transactions.

Article 9 (Purchase Application)
① Mall users shall apply for a purchase through the Mall using the following methods or similar means. The Mall shall provide the following information to users in an easily understandable manner when they make a purchase application:
    1. Searching and selecting goods or services
    2. Entering the recipient's name, address, telephone number, email address (or mobile phone number)
    3. Confirmation of the terms and conditions, services with restricted withdrawal rights, and costs such as delivery fees or installation fees
    4. Agreement to these terms and conditions and confirmation or refusal of the information specified in item 3 (e.g., mouse click)
    5. Purchase application for goods or services and agreement to the confirmation of such application or verification by the Mall
    6. Selection of payment method
② If the Mall needs to provide or outsource the buyer's personal information to a third party, the Mall must obtain the buyer's consent at the time of actual purchase application. The Mall shall specify the personal information items provided, the recipients, the purpose of using the provided personal information, and the retention and use period of the recipients' personal information. However, in the case of personal information processing entrusted under Article 25(1) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, or other cases specified by relevant laws, the relevant provisions shall apply.

Article 10 (Formation of Contract)
following apply. However, if entering into a contract with a minor, the Mall must inform them that the minor or their legal representative can cancel the contract if the consent of the legal representative is not obtained.
    1. The application contains false, incomplete, or misleading information.
    2. A minor purchases goods or services prohibited by the Juvenile Protection Act, such as tobacco or alcoholic beverages.
    3. The Mall determines that accepting the purchase application would significantly impede its technological capabilities.
② The contract is deemed to have been formed at the time when the Mall's acceptance reaches the user in the form of a receipt confirmation notification under Article 12, Paragraph 1.
③ The Mall's acceptance must include confirmation of the user's purchase application, information regarding the availability of the goods or services for sale, and the right to modify or cancel the purchase application.

Article 11 (Payment Methods)
The payment for goods or services purchased from the Mall can be made using one of the following methods. However, the Mall cannot charge any additional fees under any pretext for the payment method chosen by the user.
1. Various account transfers, such as phone banking, internet banking, or mail banking
2. Various card payments, such as prepaid cards, debit cards, or credit cards
3. Online direct deposit
4. Payment through electronic currency
5. Payment upon receipt of the goods or services
6. Payment using mileage or points provided by the Mall
7. Payment using gift certificates or vouchers authorized by the Mall or agreed upon in a contract with the Mall
8. Payment through other electronic payment methods

Article 12 (Confirmation of Receipt, Change, and Cancellation of Purchase Request)
① The Mall shall send a confirmation of receipt to the user when there is a purchase request.
② Upon receiving the confirmation of receipt, the user may immediately request a change or cancellation of the purchase request if there are discrepancies in their intention. The Mall must promptly comply with the user's request before the delivery takes place. However, if the user has already made the payment, the provisions regarding withdrawal of offer and others in Article 15 shall apply.

Article 13 (Supply of Goods, etc.)
① Unless there is a separate agreement regarding the timing of supply of goods between the Mall and the user, the Mall shall take necessary measures such as order preparation, packaging, etc. to ensure that the goods can be delivered within 7 days from the date of the user's offer. However, if the Mall has already received the full or partial payment for the goods, it shall take necessary measures within 3 business days from the date of receiving the full or partial payment. In this case, the Mall shall take appropriate measures to allow the user to confirm the supply process and progress of the goods.
② The Mall shall specify the delivery method, party responsible for bearing the delivery cost for each method, and the estimated delivery period for the goods purchased by the user. If the Mall exceeds the agreed delivery period, it shall compensate the user for any damages incurred as a result, unless the Mall can prove that there was no intention or negligence on its part.

Article 14 (Refund)
If the Mall is unable to deliver or provide the goods requested by the user due to reasons such as being out of stock, the Mall shall promptly notify the user of the reasons. If the Mall has already received the payment for the goods in advance, it shall refund the payment to the user within 3 business days from the date of receiving the payment, or take necessary measures for the refund.

Article 15(Right of Withdrawal, etc.)
① A user who has entered into a contract with the Mall for the purchase of goods or other items may withdraw the offer within 7 days from the date of receiving a written document regarding the contract, as defined in Article 13(2) of the Act on Consumer Protection in Electronic Commerce, etc. However, if there are provisions to the contrary in the Act on Consumer Protection in Electronic Commerce, etc., those provisions shall apply.
② A user who has received the goods may not return or exchange them in the following cases:
    1. If the goods are destroyed or damaged due to the user's fault (except when the packaging is damaged to inspect the goods)
    2. If the value of the goods has significantly decreased due to the user's use or partial consumption
    3. If the value of the goods has significantly decreased to the extent that resale is difficult due to the passage of time
    4. If the packaging of the original goods, which can be replicated with goods of the same performance, is damaged
③ In the cases of subparagraphs 2 to 4 of paragraph 2, if the Mall has not clearly indicated the limitation of withdrawal rights in a place easily accessible to consumers or provided measures such as offering trial products, the user's right of withdrawal shall not be limited.
④ Notwithstanding the provisions of paragraphs 1 and 2, if the content of the goods or services is different from the displayed/advertised content or if the performance deviates from the contractual terms, the consumer may withdraw from the contract or take other necessary measures for a refund within three months from the date of receiving the goods, or within 30 days from the date on which the consumer became aware of such facts.

Article 16 (Effects of Withdrawal, etc.)
① If the "Mall" receives the returned goods from the consumer, it shall refund the payment received for the goods within three business days. In case of delay in refunding the consumer for the goods, the "Mall" shall pay the consumer the delayed interest calculated by multiplying the delayed interest rate prescribed in Article 21-2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc. (the part in parentheses has been deleted).
② In the refund of the aforementioned payment, if the consumer made the payment for the goods using a credit card or electronic currency, the "Mall" shall promptly request the business operator who provided the payment method to suspend or cancel the billing of the payment for the goods.
③ In the case of withdrawal, the consumer shall bear the necessary costs for returning the received goods. The "Mall" shall not charge the consumer any penalty or damages for the withdrawal. However, if the goods are returned due to discrepancies between the content of the goods as advertised and the contractual terms, the "Mall" shall bear the cost required for the return of the goods.
④ If the consumer has paid for the shipping costs when receiving the goods, the "Mall" shall clearly indicate who bears the cost of return in an easily understandable manner when the consumer exercises the right of withdrawal.

Article 17 (Protection of Personal Information)
① The "Mall" shall collect the minimum amount of personal information necessary for providing services when collecting user's personal information.
② The "Mall" shall not collect the information necessary for the performance of the purchase contract in advance when registering as a member. However, if it is necessary to verify the identity of the individual prior to the purchase contract due to legal obligations, the minimum specific personal information may be collected, but it shall not exceed that extent.
③ When the "Mall" collects and uses personal information of users, it shall inform the users of the purpose and obtain their consent.
④ The "Mall" shall not use the collected personal information for purposes other than the intended purpose, and if there is a new purpose of use or provision to a third party, it shall inform the users of the purpose and obtain their consent during the collection or provision process. However, this shall not apply if otherwise stipulated by related laws.
⑤ When the consent of the user is required pursuant to paragraphs 2 and 3, the "Mall" shall specify or notify in advance the matters stipulated in Article 22, paragraph 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, such as the identity of the personal information protection manager (affiliation, name, telephone number, and other contact information), the purpose of collection and use, and the details of information provided to third parties (recipient, purpose of provision, and contents of information), and the user may withdraw such consent at any time.
⑥ The user may request to access and correct their personal information held by the "Mall" at any time, and the "Mall" shall promptly take necessary measures. If the user requests the correction of an error, the "Mall" shall not use the relevant personal information until the error is corrected.
⑦ The "Mall" shall be responsible for any damages incurred by the user due to the loss, theft, leakage, unauthorized provision to a third party, alteration, etc., of the user's personal information, including credit cards and bank accounts, and shall minimize the number of personnel processing the user's personal information.
⑧ The "Mall" or a third party who has received personal information from the "Mall" shall promptly destroy the relevant personal information when the purpose of collection or provision has been achieved.
⑨ The "Mall" shall not pre-select the consent form for the collection, use, and provision of personal information. In addition, the "Mall" shall clearly specify the services that will be restricted in case of refusal of consent for the collection, use, and provision of personal information and shall not restrict or reject membership registration or service provision based on the user's refusal of consent for the collection, use, and provision of non-essential personal information.

Article 18 (Obligations of the "Mall")
① The "Mall" shall not engage in acts prohibited by laws and these terms and conditions, and shall make every effort to continuously and stably provide goods or services in accordance with these terms and conditions.
② The "Mall" shall establish a security system to protect the personal information of users (including credit information) and ensure that users can safely use the Internet services.
③ If the "Mall" causes any damages to users by engaging in unfair labeling or advertising practices as defined in Article 3 of the Act on Fair Labeling and Advertising for goods or services, the "Mall" shall be liable for compensation.
④ The "Mall" shall not send commercial electronic mails for profit purposes that users do not wish to receive.

Article 19 (Obligations Regarding Member's ID and Password)
① Except for the cases specified in Article 17, the management responsibility for the ID and password lies with the member..
② Members must not allow third parties to use their ID and password.
③ If a member becomes aware that their ID or password has been stolen or is being used by a third party, they must immediately notify the "Mall," and if there are any instructions from the "Mall," they must comply with them.

Article 20 (Obligations of Users)
Users must not engage in the following actions:
1. Registering false information when applying for or modifying information.
2. Identity theft of others' information.
3. Modifying information posted on the "Mall."
4. Transmitting or posting information (such as computer programs) other than the information designated by the "Mall."
5. Infringing upon the copyright or intellectual property rights of the "Mall" or other third parties.
6. Damaging the reputation of the "Mall" or interfering with its business, or engaging in similar actions against third parties.
7. Disclosing or posting obscene or violent messages, images, audio, or any other information that violates public order and morals on the "Mall."

Article 21 (Relationship between Linking Malls)
① In the case where an upper "Mall" and a lower "Mall" are connected through methods such as hyperlinks (e.g., including text, images, and animated images as hyperlink targets), the former is referred to as the linking "Mall" (website), and the latter is referred to as the linked "Mall" (website).
② If the linking "Mall" clearly states on its initial screen or on a popup screen at the time of connection that it does not assume any warranty responsibility for transactions conducted between users and the linked "Mall" based on the goods or services provided independently by the linked "Mall," it shall not be held responsible for such transactions.

Article 22 (Ownership of Copyright and Restrictions on Use)
① The copyright and other intellectual property rights of works created by the "Mall" belong to the "Mall."
② Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise commercially utilize information obtained through the use of the "Mall" without prior consent from the "Mall" if such information is subject to intellectual property rights owned by the "Mall."
③ If the "Mall" uses copyrighted works belonging to users in accordance with an agreement, the "Mall" must notify the respective users.

Article 23 (Dispute Resolution)
① The "Mall" establishes and operates a dispute compensation body to reflect users' legitimate opinions, complaints, and compensate for damages.
② The "Mall" prioritizes the handling of complaints and opinions submitted by users. However, if prompt resolution is difficult, the "Mall" immediately notifies the user of the reasons and the expected processing schedule.
③ In the event of an e-commerce dispute between the "Mall" and a user, if the user requests relief, the matter may be resolved in accordance with the mediation of a dispute resolution organization designated by the Fair Trade Commission or the mayor/governor.

Article 24 (Jurisdiction and Applicable Law)
① Lawsuits concerning e-commerce disputes between the "Mall" and users shall be filed with the exclusive jurisdiction of the local court having jurisdiction over the user's address at the time of filing. However, if the user's address or domicile is unclear at the time of filing, or in the case of a foreign resident, the lawsuit shall be filed with the competent court under the Civil Procedure Act.
② The e-commerce lawsuits filed between the "Mall" and users shall be governed by Korean law.

Supplementary Provision (Effective Date)
These terms and conditions shall come into effect from [date].
